PREAMBLE

Travel Stadium SAS (hereinafter "Travel Stadium") is a company incorporated under French law, with a capital of €30,000, whose head office is located at 255 rue Cornaline – 13510 Eguilles

We invite you to read carefully and in their entirety these General Terms and Conditions of Sale which define the terms and conditions under which Travel Stadium markets the Gift sets, as a business provider, as well as the Conditions of Use of the Site.

Acceptance of these conditions is essential before performing any of the following actions: acquiring, receiving or using a Gift Set on the Site. By carrying out one or other of the actions mentioned above, you therefore signify your unreserved acceptance of these conditions in their entirety.

0.1 : DEFINITIONS

Gift set(es) refers to the concept of Gift sets named, developed and operated by Travel Stadium under the Tick'nBox brand.

The Gift set is composed of the following elements:

• A voucher, which allows you to benefit from the service included in the box, the latter being specified on each box.
• A brochure presenting the entire Tick'nBox offer
• A box in which all these elements are packaged

For certain references are also added:

• An official club scarf (or other official product) in the form of a voucher redeemable at the club shop
• Other elements or services in the form of a voucher

Travel Stadium reserves the right to complete the list of Gift sets (Tick'nBox) or to cease their distribution at its sole discretion and at any time.

0.2 : SCOPE OF THESE GENERAL CONDITIONS OF MARKETING

You are offered online Gift sets developed by Travel Stadium under the URL : https://www.ticknbox.com/.

The purchase of a Gift Set is reserved for users who have previously read the General Conditions in their entirety by clicking on the hypertext link provided for this purpose and who have accepted them by ticking the appropriate box. Without this acceptance, the continuation of the ordering process is technically impossible.
Consequently, the finalization of the ordering process on the Site implies express acceptance by the user of these General Terms and Conditions of Sale.

These conditions apply to the exclusion of all other conditions, in particular those in force for boxes distributed in stores.

These General Terms and Conditions of Sale are valid from October 30, 2012.

Travel Stadium reserves the right to modify these General Conditions at any time, without notice, it being understood that such modifications will not apply to orders previously accepted and confirmed by Travel Stadium.

Any customer declares to have the legal capacity in accordance with article 1124 of the Civil Code to contract and use the Site in accordance with the General Conditions of Marketing and Use of the Site.

You can place your Gift Set orders online on the Site https://www.ticknbox.com/.

You must be of legal age to place an order.

The procedure for placing orders on the Site includes the following steps :

• Selection on the Site of a Gift Set;
• Following this selection, a summary showing the choice and the total price of the Gift Set selected, your contact details, any shipping costs, your method of payment, will allow you to check the details of your order and thus make changes. necessary, before the final registration of your order;
• Your order will only be registered at your last validation.
• In the event of payment by credit card, this "second click" will correspond to the moment of registration of your bank details. However, your contract will only be definitively concluded after acceptance of payment by your bank;
• From the final validation of your order, we will send you an e-mail confirming your order summarizing all the elements relating to it. By printing and/or keeping this e-mail, you will have a means of proof attesting to your order.

2.1 :

In the event that you are not the Beneficiary of the Gift Set, you are invited to inform the Beneficiary of the conditions set out below.

2.2 :

This Gift Set is only valid after activation at checkout in your store.

2.3 :

This Gift Set is valid until the expiry date (or for the period) which is generally 2 years after the date of purchase of the Gift Set.

2.4 :

This Gift Set is generally exchangeable for 2 tickets/entries (sometimes more or less depending on the reference chosen) for the same event, among those associated with the selected box present on the site https://www.ticknbox.com/

2.5 :

All events are offered according to the seat quotas allocated by the Partner. Tick'nBox cannot be held responsible for any unavailability of the chosen date. It is advisable to book as early as possible in order to benefit from the widest possible choice.

2.6 :

For security reasons, no change of reservation will be accepted. In case of cancellation of the event, the voucher will be usable again for a new date.

2.7 :

In the event of non-use, loss or destruction of the gift voucher, neither the buyer nor the end user will be entitled to a refund.

2.8 :

This gift voucher is exchangeable or renewable according to certain conditions which can be consulted on the Assistance website.

The extension is available within the limit of the duration of the contract between Travel Stadium and the partner concerned.

2.9 :

Only the presentation to the Partner by the Beneficiary, of the electronic ticket received by email, gives access to the service included in the box.

In the case of a withdrawal of tickets on site, the identity document of the person who booked is authentic.

2.10 :

Delivery of the Service is subject to the specific conditions of the selected Partner. In the event of cancellation of the reserved event, the ticket will be reset to allow you to choose another date.

2.11 :

In the event of non-use, loss, theft or destruction of the electronic ticket (email)/PDF or voucher, the Beneficiary may not claim a refund or compensation of any kind whatsoever.

2.12 :

Travel Stadium may terminate its relationship with one or more Partners during the validity period of the Tick'nBox Gift Set, in order to ensure, in particular, an optimal level of quality of the Services.

2.13 :

The value of the tickets that make up the Tick'nBox is the same as that of the Partner's price list, for an equivalent service (placement, catering, merchandising, etc.)

In the case of a sports box, placement in the stadium then depends on the Partner's pricing policy. Depending on the team, the poster or the stadium, the placement may therefore vary to best comply with the Partner's pricing policy.

2.14 - PERSONAL DATA :

By using the box, I accept that my data will be kept by Tick'nBox and by the ticketing partner for the sole purpose of allowing the proper monitoring of my reservation, as well as my data being used anonymously for statistical purposes. (geographical origin, already come to the events of the partner, etc...).

3.1 : PRICE

The prices of the Gift Sets, displayed on the Site, are those in force on the day of the order.

The shipping costs, defined in article 6.4, applied for the delivery of the Gift Sets are not included in the price of the giftset, unless expressly mentioned by Tick'nBox.

3.2 : PAYMENT CONDITIONS

This gift voucher can be exchanged for the service included in the box, the latter being specified on each box.

The payment of the order will be made exclusively by bank card according to the following methods:

• Indicate directly in the area provided for this purpose, the card number, its validity date, as well as its control code located on the back of the card.
• The full amount of the order will be debited from the bank card on the day of the order.
• Travel Stadium reserves the right to suspend any processing of the order in the event of refusal of payment authorization by your bank.
• The Site allows you to transmit your bank details in a confidential and secure manner, when placing your order (secure entry by SSL encryption).

When purchasing a Gift set on the Site, under the terms of Article L.221-18 of the Consumer Code, you have a period of 14 (fourteen) clear days to exercise your right to withdrawal without having to justify reasons, nor to pay penalties, with the exception of return costs.

Once the box has been used, this right of withdrawal does not apply to reserved tickets. These are neither cancellable nor exchangeable.

Return costs will be your responsibility. Only Gift Sets returned on time and in perfect condition can be refunded.

Any return made in accordance with the conditions of this article will give rise to a refund of all sums paid (excluding return costs), at the latest within fourteen (14) days from the nearest of the following two dates: (i) receipt by Travel Stadium of the Gift set in perfect condition or (ii) transmission to Travel Stadium of proof of shipment of the Gift Set in perfect condition.

To exercise the right of withdrawal, you must notify us of your decision to withdraw by means of an unambiguous statement (eg letter sent by post, fax or e-mail). You can also use the model withdrawal form accessible via the following link: withdrawal form

You are expressly informed that, except for manifest error of which you would provide proof, the data stored in the databases of Travel Stadium have probative value with regard to orders placed.

Data on computer or electronic media stored regularly constitute admissible and enforceable evidence in the same terms and with the same probative force as any document that would be received and stored in writing.

6.1: AVAILABILITY OF Gift SetES

The Gift Sets are products produced in limited quantities, on the one hand because of the limited reception capacities of the Partners and on the other hand because of the limited period of validity in time of the Gift Sets.

In the event of a temporary or permanent stock shortage, the Customer will be informed of this unavailability because the order cannot be completed in this format.
In the event of product availability, Travel Stadium SAS undertakes to honor any Tick'nBox order from the Customer.

If an order cannot be fulfilled due to out of stock, you have two options:

• Or, cancel your order. You will then be reimbursed for all the sums paid, within 14 days at the latest;
• Or benefit from an exchange of Gift Sets.

6.2: PLACE OF DELIVERY

Travel Stadium only ships Gift Sets in Metropolitan France.

The Gift Sets will be delivered to you at the address you indicated when entering your order. Travel Stadium cannot therefore be held liable for any reason whatsoever in the event of absence on your part during the delivery of the Gift Set or in the event of an input error, on your part, during the placing the order. It will be your responsibility to contact Travel Stadium under the conditions set out in Article 11.

6.3: DELIVERY METHOD AND DELIVERY TIME

The delivery will be made by letter followed or Chronopost, according to the wishes of the buyer. You will receive an email confirming shipment of your order. If you have chosen the Chronopost delivery method, your carrier tracking number will be indicated on the mail, allowing you to follow the delivery of your order. Unless otherwise stated on the site, the shipping times will be as follows:

In letter followed

• Same day dispatch (if working days) for orders made before 2:00 p.m.
• Next day shipping (if working days) for orders made after 2:00 p.m.

By Chronopost

• Same day dispatch (if working days) for orders made before 2:00 p.m.: next day delivery before 1:00 p.m. (except weekends)
• Next day dispatch (if working days) for orders made after 2:00 p.m.: delivery the next day before 1:00 p.m. (except weekends)

This information is communicated by Chronopost and is sent to you for information purposes only. However, in the event of manifest delay, Travel Stadium undertakes to implement any useful action in order to control and then resolve any malfunction of the transport service.

6.4: SHIPPING COSTS

The shipping costs are fixed and are invoiced in addition to the price of the Gift Sets as follows:

• Delivery by letter followed: €3.90 for 1 box / €5.90 for 2 boxes and more
• Delivery by Chronopost: €15

7.1: RESERVATIONS TO MAKE TO THE CARRIER FOR DAMAGES OR MISSINGS

Any Gift Set delivered must be carefully checked by the Customer and any reservations made on the carrier's slip in the event of partial or total deterioration.

The Customer must also indicate and justify, to the carrier, his reservations by e-mail with acknowledgment of receipt (or registered letter), within 72 working hours from receipt of the contested Gift Set.

In the absence of reservations, the product is deemed delivered in good condition and cannot be the subject of any subsequent dispute with Travel Stadium.

7.2: TRAVEL STADIUM ERROR

The Customer must formulate by letter or email ("Help" section of the Site), within 72 working hours from receipt of the order, any error relating to the Boxes ordered.

Any complaint relating to the Gift Sets not made in the rules of this article and within the time limits cannot be taken into account and will release Travel Stadium from any liability vis-à-vis the Customer.

The transfer of ownership and risks will take place at the time of delivery of the Gift Set(s) to the Customer.

The Gift Sets have a limited period of validity specified on their packaging and on the website.

Any other request for information and details regarding, in particular, the purchase, refund, exchange, operation of the Gift Sets, must be addressed to Travel Stadium:

The Website https://www.ticknbox.com/ is regularly declared to the CNIL under the registration number mkf0653083b.

Concerned about the respect of the private life of the user and the protection of the information which is transmitted to him, Travel Stadium respects the legislation in force as regards protection of the private life.

Travel Stadium informs you that it will be required to collect the necessary personal data concerning you when placing your order, when requesting verification of the validity of your Gift Set.

By purchasing the box, I agree that my data will be kept by Tick'nBox for the sole purpose of allowing the proper monitoring of my order, as well as that my data will be used anonymously for statistical purposes (geographical origin, age , etc...).

11.1: COOKIES

The User is informed that the site uses cookies designed to be used only by Travel Stadium.

At each connection to the site, cookies make it possible, for example, to record the following information: the type and version of the User's browser, the dates and times of the visit, the history and content of orders, including in the event of purchase not finalized.

Thus, during his next connections, the User no longer needs to enter certain information again.

To benefit from all of the Site's functionalities, it is therefore preferable that the User configure his Internet browser (for example Internet Explorer, Mozilla Firefox, Safari.) so that it accepts cookies.

However, the User may oppose the registration of these cookies. Indeed, most Internet browsers allow you to configure the Internet and security options or the User's preferences in order to refuse or deactivate cookies, or even to obtain a message which will notify the User of the sending of Cookies.

Travel Stadium acts as a business provider or intermediary (depending on the contractual relationship with the partner) by offering Customers Gift sets, allowing them to benefit from a service offered and performed by one of the Partners, selected by Travel Stadium.

Travel Stadium's liability is therefore limited to that of business provider for the sale of vouchers.

In accordance with Article L. 217-4 of the Consumer Code, Travel Stadium undertakes to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. Travel Stadium is also liable for lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been charged to it by the contract or has been carried out under its responsibility.

The legal guarantee of conformity applies independently of any commercial guarantee granted.

The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and that in this case, he can choose between the resolution of the sale or a reduction of the selling price. in accordance with article 1644 of the civil code.

Travel Stadium has taken out civil and professional liability insurance with well-known insurance which covers in particular the pecuniary consequences which may be the responsibility of the insured due to bodily, material and immaterial damage caused to the Beneficiary as a result of faults, errors of fact or by law, omissions or negligence committed during its activity as a gift set issuer.

The elements making up the gift sets, in particular in the form of texts, photographs, images, icons, logos, are the full and exclusive property of Travel Stadium. It is strictly forbidden to reproduce, represent, modify, transmit, publish, adapt, on any medium whatsoever, by any means whatsoever, or to exploit in any way whatsoever, all or part of the elements mentioned in preceding paragraph without the prior written authorization of Travel Stadium.

The fact that Travel Stadium does not avail itself at a given time of one of the clauses of these General Terms and Conditions of Sale cannot be interpreted as a waiver, on the part of Travel Stadium, to subsequently avail itself of any of the said conditions.

In the event that one of these provisions should be declared null or deemed unwritten, the validity of the other provisions of the General Terms and Conditions of Sale will not be called into question.

The law governing these General Terms and Conditions of Sale and the contract concluded when ordering a Gift Set is French law for all disputes relating, in particular, to their validity, interpretation, execution or termination.

The competent court in the event of a dispute will be that of the place of residence of the defendant or, at the choice of the plaintiff, of the place of actual delivery of the Product.

It is recalled that you have the possibility, in the event of a dispute, of a mediation procedure, in accordance with the provisions of articles L. 211-3 and L. 612-1 and following of the consumer code.
